1. I authorize MJR Marketing, LLC d/b/a SportLife Distribution to charge the card below for authorized purchases and applicable fees. I certify that I am authorized to use this card and, if signing on behalf of a business, that I have authority to bind the business. If this card is used for purchases on behalf of a business, I personally guarantee payment to MJR Marketing, LLC d/b/a SportLife Distribution of all amounts not paid by the business, including lawful collection costs and reasonable attorneys’ fees where permitted by law. If payment is not received within the applicable Net 30 payment terms, any invoice remaining unpaid after 30 days will be subject to a late fee of 5% per month on the outstanding balance, or the maximum amount permitted by applicable law, whichever is less. This authorization shall remain in effect until revoked in writing and accepted by MJR Marketing, LLC d/b/a SportLife Distribution, and such revocation shall not affect any prior obligations. The credit card provided will be securely saved on file and used to process payment for purchases made on the account. The card will not be charged until the first order is placed. Orders will not be shipped until payment has been successfully processed.
2. Customer signing this agreement agrees not to sell any products via any third-party-facilitated online retail or online auction website (including, but not limited to: eBay, Amazon.com, NexTag.com, PriceGrabber.com, Shopzilla.com, Best-Price.com, or any other online retail or online auction websites which sell products similar in character to products). Customer acknowledges and agrees that this prohibition is necessary to ensure safety and the integrity of the products. Notwithstanding the foregoing, customer shall be permitted to sell individual unit-volumes of its products on its own direct website. SportLife Distribution reserves the right to prohibit sales of the products on customer’s own direct website, at any time, upon written notice to customer.
3. Claims arising from invoices must be made within seven working days after delivery. In addition to all other amounts payable by Customer hereunder, Customer agrees to pay to SportLife Distribution upon demand, any and all late fees incurred including interest, costs and expenses incurred in collecting overdue and past due invoices including any court costs any reasonable Attorneys’ fees which SportLife may incur in enforcing the obligations of Customer hereunder.
